Welcome to iFund.
These Terms & Conditions ("Terms") govern your access to and use of the iFund mobile application, website, and related services (collectively, the "Platform").
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Platform.
1. About iFund
iFund is a digital platform intended to facilitate communication and information exchange between borrowers and potential lenders.
The Platform may allow users to create profiles, submit loan-related requests, explore funding opportunities, and communicate with other users.
Important Platform Limitation
At the current stage of the Platform:
iFund does not process real-money transactions.
iFund does not hold or transfer user funds.
iFund does not provide loans.
iFund does not guarantee that any loan or funding request will be approved or funded.
iFund does not act as a bank or financial institution.
iFund does not provide financial, investment, legal, tax, or lending advice.
iFund does not currently perform KYC or identity verification.
Any future financial or transaction-related features may be governed by additional terms and requirements.
You must be at least 18 years old, or the legal age of majority applicable in your jurisdiction, to use iFund.
By using the Platform, you represent and warrant that:
You meet the applicable age requirement.
You have the legal capacity to enter into these Terms.
The information you provide is accurate and not misleading.
You will comply with all applicable laws and regulations.
3. User Accounts
Certain features of iFund require you to create an account.
You agree to:
Provide accurate and complete information.
Keep your account information current.
Maintain the confidentiality of your login credentials.
Take reasonable steps to prevent unauthorized access to your account.
Notify us promptly if you believe your account has been compromised.
Accept responsibility for activity occurring through your account, except where caused by circumstances outside your reasonable control.
You must not create an account using another person's identity or information without authorization.
4. User Profiles and Content
Users may submit information, profiles, loan requests, funding-related information, messages, and other content through the Platform ("User Content").
You are responsible for the accuracy, legality, and appropriateness of the User Content you submit.
By submitting User Content, you represent that:
You have the right to provide the information.
The information is accurate to the best of your knowledge.
The information does not knowingly violate applicable laws.
The information does not infringe another person's rights.
The information does not contain malicious software or harmful code.
5. Acceptable Use
You agree not to use iFund to:
Provide false, misleading, or fraudulent information.
Impersonate another person or organization.
Commit or facilitate fraud.
Attempt to obtain unauthorized access to accounts, systems, or data.
Interfere with or disrupt the Platform.
Introduce malware, viruses, or other malicious code.
Scrape, copy, or systematically extract Platform data without authorization.
Circumvent security or access controls.
Use the Platform for unlawful activities.
Harass, threaten, abuse, or deceive other users.
Upload content that violates applicable law or the rights of others.
Use the Platform to facilitate money laundering, terrorist financing, or other prohibited activities.
Use the Platform in a manner that could damage, disable, overburden, or impair the service.
We reserve the right to investigate suspected violations.
6. User-to-User Interactions
iFund may facilitate communication between users.
iFund is not a party to agreements, negotiations, communications, or transactions that users may enter into with one another.
Users are solely responsible for evaluating the information provided by other users and for making their own decisions.
iFund does not guarantee:
The identity of another user.
The accuracy of information provided by another user.
The creditworthiness of any borrower.
The ability or willingness of any lender to provide funding.
That any loan request will receive funding.
That any communication will result in an agreement.
Users should exercise appropriate caution when communicating or sharing information with other users.
7. No Financial Advice
Nothing available through iFund should be interpreted as financial, investment, lending, legal, tax, or professional advice.
Users are responsible for obtaining independent professional advice where appropriate.
Any financial decisions made based on information obtained through the Platform are made entirely at the user's own risk.
8. No Guarantee of Funding
Submitting a loan request or funding opportunity through iFund does not guarantee that funding will be obtained.
iFund does not guarantee approval, funding, repayment, interest rates, returns, or any other financial outcome.
9. Intellectual Property
The Platform and its contents, including software, source code, designs, interfaces, graphics, logos, trademarks, text, and other materials, are owned by or licensed to iFund and are protected by applicable intellectual property laws.
Except as expressly permitted by these Terms or applicable law, you may not:
Copy or reproduce the Platform.
Modify or create derivative works.
Distribute or publicly display Platform materials.
Reverse engineer or attempt to extract source code.
Use iFund branding without written permission.
Commercially exploit Platform content without authorization.
10. User License
Subject to your compliance with these Terms, iFund grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes.
This license does not transfer ownership of any iFund intellectual property to you.
11. Third-Party Services
The Platform may rely on or integrate with third-party services, including hosting, authentication, analytics, communication, and other technology providers.
Third-party services may have separate terms and privacy policies.
iFund is not responsible for the availability, functionality, security, or policies of third-party services that are outside our reasonable control.
12. Availability of the Platform
We aim to keep iFund available and functioning reliably, but we do not guarantee uninterrupted or error-free operation.
The Platform may occasionally be unavailable because of:
Maintenance.
Updates.
Technical failures.
Security incidents.
Infrastructure problems.
Network interruptions.
Third-party service failures.
Circumstances beyond our reasonable control.
We may modify, suspend, or discontinue any part of the Platform at any time, subject to applicable law.
13. Account Suspension and Termination
We may suspend, restrict, or terminate your access to iFund if:
You violate these Terms.
You provide false or misleading information.
We reasonably suspect fraud or abuse.
Your activity creates security or legal risks.
Your activity may harm other users or the Platform.
We are required to do so by law.
We discontinue the relevant service.
You may stop using the Platform at any time.
Upon termination, provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, and dispute-related provisions, will continue to apply.
14. Privacy
Your use of the Platform is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, iFund is provided on an "as is" and "as available" basis.
We do not guarantee that:
The Platform will always be available.
The Platform will be error-free.
Information provided through the Platform will always be accurate or complete.
The Platform will meet every user's requirements.
Any user or funding opportunity will be legitimate, suitable, creditworthy, or reliable.
Any funding request will be approved or funded.
You use the Platform at your own risk.
16. Limitation of Liability
To the maximum extent permitted by applicable law, iFund and its owners, directors, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from or related to your use of, or inability to use, the Platform.
This includes losses arising from:
User decisions.
Communications between users.
Information provided by users.
Funding opportunities or loan requests.
Service interruptions.
Technical failures.
Third-party services.
Unauthorized access, except to the extent caused by our failure to meet obligations that cannot legally be excluded.
Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.
17. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless iFund and its owners, directors, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:
Your violation of these Terms.
Your misuse of the Platform.
Your User Content.
Your violation of applicable laws or the rights of another person.
Your interactions or dealings with other users.
18. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we may notify you through the Platform, by email, or through another appropriate method.
Your continued use of iFund after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
19. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which iFund is legally registered and operates, subject to applicable conflict-of-law principles.
The specific governing jurisdiction and competent courts will be confirmed and incorporated into these Terms before final publication.
20. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
21. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms applicable to specific features, constitute the agreement between you and iFund regarding your use of the Platform.
